The Federal Supreme Court decided that the Criminal Action investigating defendants must continue in court. The process investigates fraudulent loans made by BMG bank to the Workers' Party and the group of companies belonging to Marcos Valério. Two appeals were presented to request the dismemberment of the process. The intention was that only federal deputy José Genoíno, who holds jurisdictional prerogative in the Supreme Court, would continue to respond in court.
The appeals were denied by a majority vote. Minister Marco Aurélio, the only one to speak out in favor of the dismemberment, declared that defendants who do not have jurisdiction prerogative in the Supreme Court should respond in the th Federal Court of Minas Gerais. The complaint was received by the court itself before being forwarded to the STF.

Marcos Valério, as manager of SMP&B Comunicação, was a guarantor, with Genoíno, of the same loan granted to PT.
“As can be seen, this is a formation of the joint will of the defendants, and it is not possible to analyze the accusation of ideological falsehood directed against the deputy without analyzing the conduct attributed to the other defendants, both of ideological falsehood and fraudulent management of a financial institution , which would have been carried out precisely because of the granting of suspicious loans”, stated Joaquim Barbosa.
